Our Responsibilities
By law, we must:
– Protect your medical information (called “Protected Health Information” or PHI)
– Make this notice of our privacy practices available to you at any time, by request
– Follow the terms of this notice
– Tell you if there is a breach (unauthorized access) to your unsecured PHI
We may change this notice at any time. Updates will be posted in our office and on our website.
How We May Use and Share Your Information Without Your Written Permission
We may use or share your PHI for:
– Treatment – Sharing with doctors, specialists, or other health providers to care for you
– Payment – Billing your insurance company or collecting payment for our services
– Healthcare operations – Improving our services, training staff, and managing our practice
We may also share your PHI when:
– Required by law
– Reporting public health concerns (disease control, product recalls, exposure to illness)
– Reporting abuse, neglect, or domestic violence
– Responding to legal requests (court orders, subpoenas)
– Working with law enforcement in specific situations
– Assisting coroners, medical examiners, and funeral directors
– Conducting internal research (using only de-identified information unless you authorize otherwise)
– Preventing serious threats to health or safety
– Working with military, veterans, or correctional programs
– Handling workers’ compensation claims
Situations Where We Will Ask for Your Permission
We must get your written authorization before:
– Using or sharing your PHI for marketing purposes
– Selling your PHI
– Using your PHI for fundraising (and you have the right to opt out)
– Sharing your PHI for any reason not listed in this notice
You may cancel (revoke) your authorization in writing at any time.
Special Rights You Have
You have the right to:
1. Ask us to limit how we use or share your PHI – We don’t have to agree, unless you pay for a service in full and ask us not to share that service information with your health plan.
2. Ask for changes in private communications – For example, we can call you at a different number or send mail to another address.
3. See and get a copy of your records – You can ask for a paper or electronic copy in the format you choose (if available). We may charge a reasonable fee for copies.
4. Request corrections to your records – If something is wrong or missing, you can ask us to fix it.
5. Get a list of certain disclosures – You can ask for a record of when we shared your PHI for purposes other than treatment, payment, and healthcare operations.
6. Get a copy of this notice – You can ask for a paper or electronic copy at any time.
7. Opt out of email marketing or communications at any time by unsubscribing or contacting our office.
If There’s a Problem
If you believe your privacy rights have been violated:
– You can file a complaint with us and an investigation into your complaint will be completed. Our company has a no retaliation policy and you will receive a report of our findings. If you are not satisfied with our report or wish to file a complaint elsewhere:
– You can also file a complaint with the U.S. Department of Health & Human Services or the WV Attorney General
